Terms of Service

Effective October 22, 2026 · Updated October 22, 2026

The short version. DockPulse helps your team track boat issues, checklists, and maintenance. Your company owns its data. Subscriptions are month to month, and you can cancel anytime. DockPulse is a record-keeping and communication tool. It does not inspect boats or decide whether one is safe, so your company stays fully responsible for its vessels, crew, and customers. Please read section 6 carefully.

1. The agreement

These Terms of Service ("Terms") are an agreement between DockPulse LLC, a Florida limited liability company ("DockPulse," "we," "us"), and the business that signs up for DockPulse (the "Customer"), and they also apply to every person who uses DockPulse through a Customer's account (each a "User"). They cover the DockPulse iPhone app, the website at dockpulse.io, and the related services (together, the "Service").

By creating an account, joining with an invite code, or using the Service, you agree to these Terms and acknowledge our Privacy Policy, which explains how we handle information. If you accept on behalf of a company, you confirm that you're authorized to bind that company. If you don't agree, don't use the Service. If a Customer has signed a separate written agreement or order with DockPulse, that document controls where it conflicts with these Terms.

2. The Service

DockPulse lets rental operators record boats, report and track issues, run checklists, log maintenance and engine hours, assign work, and notify team members. We're improving DockPulse all the time, so features may be added, changed, or removed. If we remove a feature a Customer relies on, we'll give reasonable notice. Free trials, pilot programs, and features we label as beta or preview are provided as is, for evaluation, and may change or stop working.

3. Accounts and users

4. Your data

The Customer owns the records its Users put into DockPulse, including boats, issues, photos, checklists, maintenance logs, comments, and tasks ("Customer Data"). The Customer gives DockPulse permission to host, store, copy, process, and display Customer Data only as needed to provide, secure, support, and improve the Service and as described in the Privacy Policy. We don't sell Customer Data and we don't use it for advertising.

DockPulse processes Customer Data only to provide the Service under these Terms and as the Customer directs through its use of the Service. The Customer is responsible for the accuracy of Customer Data, and confirms that it has given its Users any notices and obtained any consents the law requires, and that it has the right to upload its Customer Data, including photos that may show people.

While the subscription is active and for 30 days after it ends, the Customer may ask us for an export of its Customer Data. When a User deletes their account, we remove their name from Customer Data as described in the Privacy Policy, and the records they created stay with the Customer.

If we confirm unauthorized access to Customer Data, we'll notify the Customer without undue delay and within any period the law requires.

5. Acceptable use

You agree not to:

We may suspend access that violates these rules or puts the Service or other Customers at risk. Where reasonable, we'll contact the Customer first.

6. Safety: DockPulse is a tool, not an inspector

DockPulse records and shares information that your team enters. It does not inspect, test, or certify any vessel or equipment, and it does not decide whether a boat is safe to operate or rent. Severity levels such as "Do Not Send," fleet status, checklists, maintenance reminders, and engine hour tracking depend on the information your Users enter and on your settings, and they may be incomplete, out of date, or wrong.

A boat that shows no open issues, or only Sendable or Needs Attention issues, has not been inspected or approved by DockPulse. Every decision to operate, rent, or hold a vessel is the Customer's, and DockPulse is not responsible for it.

The Customer is solely responsible for:

Notifications and app updates depend on phones, networks, and services we don't control, including Apple, wireless carriers, and internet providers. They can be delayed or never arrive. Do not rely on DockPulse as your only way to communicate safety-critical information. In an emergency, call 911 or contact the U.S. Coast Guard on VHF channel 16.

7. Plans, fees, and payment

DockPulse subscriptions are sold directly to businesses for use by their teams. No purchases are made within the iPhone app.

8. Canceling and ending the agreement

A Customer can cancel at any time by emailing will@dockpulse.io. Cancellation takes effect at the end of the current paid month. We may end these Terms or suspend the Service if the Customer materially breaches them and doesn't fix the breach within 15 days of notice, immediately for serious misuse or illegal activity, or with 30 days' notice if we discontinue the Service. When the agreement ends, access stops, and Customer Data is handled as described in section 4 and the Privacy Policy. Sections that by their nature should survive will survive, including 4, 6, 7 (for amounts owed), and 9 through 16.

9. Our property and feedback

DockPulse and its software, design, and branding belong to DockPulse LLC and its licensors. Subject to these Terms, we give the Customer and its Users a limited, non-exclusive, non-transferable right to use the Service for the Customer's internal business while the subscription is active. If you send us ideas or feedback, we may use them without any obligation to you.

10. Third-party services

The Service relies on third-party providers, including Apple, to deliver the app and notifications. Their services are governed by their own terms, and we aren't responsible for their outages or actions. When you use the Service, you must also follow any third-party terms that apply to you, such as your wireless carrier's terms.

11. Disclaimers

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DOCKPULSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT NOTIFICATIONS OR DATA WILL BE DELIVERED, ACCURATE, OR COMPLETE. Some jurisdictions don't allow some of these disclaimers, so they may not all apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY: (A) DOCKPULSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, OR DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) DOCKPULSE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE FEES THE CUSTOMER PAID DOCKPULSE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100. These limits do not apply where the law does not allow them, including liability that cannot be limited for gross negligence, willful misconduct, or fraud.

13. Indemnification

The Customer will defend and indemnify DockPulse LLC and its members, employees, and contractors against third-party claims, and the resulting losses, damages, and reasonable legal fees, arising from: (a) the operation, maintenance, rental, or use of the Customer's vessels and equipment; (b) Customer Data; or (c) the Customer's or its Users' violation of these Terms or the law. This includes claims alleging that the Service, or DockPulse's own negligence, contributed to the harm, except to the extent the harm was caused by DockPulse's gross negligence or willful misconduct. We'll give the Customer prompt notice of the claim and reasonable cooperation.

14. Governing law and disputes

Florida law. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, and by applicable federal law.

Talk first. Before filing any claim, other than a claim to collect unpaid fees, each side agrees to try to resolve the dispute informally by contacting the other in writing and talking in good faith for at least 30 days.

Where to file. Any lawsuit must be brought in the state courts located in Okaloosa County, Florida, or, if federal jurisdiction exists, in the United States District Court for the Northern District of Florida, Pensacola Division, and both sides consent to those courts' jurisdiction. Either side may instead bring an individual claim in small claims court if it qualifies. Either side may seek urgent injunctive relief in any court with jurisdiction.

No class actions. Claims may be brought only on an individual basis, and not as a plaintiff or class member in any class, consolidated, or representative action.

Jury waiver. EACH SIDE KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY LAWSUIT ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

Attorney's fees. In any lawsuit arising out of these Terms, including a suit to collect unpaid fees, the prevailing side may recover its reasonable attorney's fees and costs.
